Applying to the Planning Board:

A Step-by-Step Guide for Cases Requiring Hearings

 

The following steps outline the process of applying for action by the planning board. It is important to note that this is a general guide, and your application may require additional information. For a more detailed and comprehensive guide, please refer to the "Planning Board Instructional Booklet."

Step 1: Submission of the Staff Committee Review Application. Notification of the review outcome will be communicated to you via email. 

The submission package for staff committee review must include the following items:

  • Completed Staff Committee Review Application with the $25.00 application fee payable to the City of Margate.
  • One set of plans.
  • A detailed narrative description of the proposed project.
  • A scaled drawing.
  • A land survey and flood elevation certificate.

Step 2: Submission of the Application for Action by the Planning Board. Once you receive approval from the Staff Committee, you may proceed with submitting your Planning Board Application. Refer to the Staff Committee Review for detailed information on the hearing date, required fees, submission deadlines, and any additional requirements stipulated by the staff committee. 

The submission package for the planning board application must include the following items:

  • Completed Application for Action by the Planning Board with the application fee(s), which are specified in the Staff Committee Review, payable to the City of Margate. For multiple fees, separate checks are required.
  • Application Checklist.
  • A copy of your Staff Committee Application and Review.
  • All necessary plans (signed, sealed, and folded).
  • Current and dated photographs depicting each view of the premises.
  • Written evidence of ownership (deed).
  • Confirmation of current tax, water, and sewer payments (obtained by contacting the Tax Collector's Office).
  • Certified tax list (obtained by contacting the Tax Assessor's Office).
  • Notarized Corporate Disclosure Form, if applicable.
  • A digital copy of the application and plans, which will be uploaded onto our website for public access. 
  • Additionally, provide 17 organized and collated identical packages, each containing copies of the Planning Board Application, Application Checklist, Staff Committee Application and Review, Corporate Disclosure Form (if applicable), and all necessary plans (signed, sealed, and folded), along with current and dated photographs depicting each view of the premises. In other words, submit one original application package with all items included, plus 17 collated identical packages.

Step 3: Submission of Proof of Advertising/Notification of Neighbors. Legal notification to adjoining property owners via the certified list obtained from the Tax Assessor and the legally required public advertisement must occur no later than 10 days prior to the hearing. Evidence of advertising and notification must be submitted to the Board Administrator by the Monday preceding the hearing. 

The submission package for proof of notification and advertisement must include the following items:

  • A copy of the certified tax list obtained from the Tax Assessor with a copy of the notice sent to the property owners.
  • Certified Mail Receipts (stapled to each returned green card) arranged in the same order as the tax list.
  • Completed Proof of Service form.
  • Proof of Publication for the advertisement.

Step 4: Attending the Hearing. If deemed complete, your case will be placed on the meeting agenda. The Zoning Officer's report will be sent to you via email before the scheduled meeting. Additionally, the agenda will be published on the City of Margate Planning Board webpage 48 hours in advance of the hearing. 

Step 5: Post-Approval Process. If your application is approved by the Planning Board, you will receive an information sheet from the Board Administrator. This document provides details on the decision and resolution process, the appeal period, the time frame for securing building permits, instructions for submitting compliance plans, and the expiration of board approval. A copy of the decision and resolution will be sent to you via email once it is adopted. It is important to note that even with Planning Board approval, you are still required to obtain both zoning and building permits through the Building Department before commencing your project.
